THE FOLLOWING SWEEPSTAKES IS INTENDED FOR PLAY ONLY IN THE 50 UNITED STATES AND D.C. AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN ONE OF THE 50 UNITED STATES OR D.C. AT THE TIME OF ENTRY.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE THE CHANCE OF WINNING. VOID WHERE PROHIBITED. BY ENTERING, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE JUDGES, WHICH SHALL BE FINAL IN ALL RESPECTS.
1. ELIGIBILITY: The DORITOS® brand Unlock Xbox Voting Sweepstakes (“Sweepstakes”) is open only to legal residents of any of the 50 United States or the District of Columbia who are 13 years of age or older and in the state of Maine the Sweepstakes is only open to participants who are 18 years of age or older at time of entry. The following individuals are not eligible: Employees, contractors, directors and officers of Frito-Lay, Inc., Microsoft Corporation, Microsoft’s third party Beta Game developer(s), and each of their respective parents, subsidiaries and affiliated companies, distributors, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, the “Promotion Parties”), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and or “step” of each) and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes). The Top 8 Quarter Finalists in the DORITOS® brand Unlock Xbox 2 Contest may participate in this Sweepstakes, but must comply with these Official Rules.
2. SWEEPSTAKES VOTING PERIOD: The Sweepstakes begins at 12:00 p.m. Central Time (“CT”) on November 29, 2009 and ends at 11:59 p.m. CT on December 31, 2009 (“Sweepstakes Voting Period”). The Sweepstakes Voting Period is separated into daily entry periods. A “Day” is defined as the 24 hours between 12:00:00 a.m. (midnight) CT and 11:59:59 p.m. CT (with the exception of the first Day which will begin at 12:00 p.m. [noon] CT).
3. TWO WAYS TO ENTER: To enter, you must register and vote for the Unlock Xbox arcade game idea you like best by reviewing each of the Top 8 Quarter Finalists' presentations (“Presentations”) from those competing in the DORITOS® brand Unlock Xbox 2 Contest. There are two mediums from which you may vote: (a) Vote via the Xbox LIVE service or (b) Vote online at www.unlockbox.com (each a “Medium”). To enter for a chance to win a copy of Halo 3 ODST (you must be 17+ to be awarded this game title), vote via the Xbox LIVE service (“Xbox LIVE”). To enter for a chance to win an Xbox 360 Arcade console, vote online at www.unlockxbox.com. You may enter for a chance to win both prizes, however, limit one (1) vote per Medium per person and per Xbox LIVE gamertag per Day (for a total of two (2) votes per Day). (a) To vote via Xbox LIVE: Access an Xbox 360 console, log into the Xbox LIVE Marketplace, navigate to the Contest advertisements running on the Xbox LIVE dashboard, click on the link and then cast one (1) vote for your favorite Presentation by downloading the unique gamer picture for your favorite Presentation as instructed. (b) To vote online at www.unlockxbox.com: Access www.unlockxbox.com and follow the instructions to register and vote for your favorite Presentation. Each Day that you place a vote via Xbox LIVE, you will receive one (1) entry into the drawing, to be conducted for that Day, for a chance to win a copy of Halo 3 ODST. Each Day that you place a vote online at www.unlockbox.com, you will receive one (1) entry into the drawing to be conducted for that Day for a chance to win an Xbox 360 Arcade console. Any other forms of entry are void. All entries must be received and recorded during the Sweepstakes Voting Period. Sponsors' time clock is the official clock for this Sweepstakes. In the event of an identity dispute, entry will be considered made by the registered owner of the email address used for entry. All entrants must have a valid email address.
4. DRAWING: One (1) winner per Medium will be selected in a random Daily drawing from among all eligible entries received (for that Medium) for each Day of the Sweepstakes Voting Period. The random Daily drawings will take place on or about the following Day of each Day of the Sweepstakes Voting Period. Non-winning entries will not carry forward to subsequent Daily drawings. All drawings will be conducted by an independent judging organization whose decisions shall be final. Odds of winning depend upon the number of eligible entries received per Medium corresponding to each daily drawing. Limit one (1) prize per Medium per person/household.
5. PRIZE DETAILS: “Vote on Xbox LIVE” Prizes (33 total; one [1] for each Day of the Sweepstakes Voting Period): Each winner will receive a copy of Halo 3 ODST. If winner is under 17 years of age, Sponsor will substitute an age appropriate game title, in its sole discretion. Approximate Retail Value (“ARV”): $60.00 each. “Vote Online at www.unlockxbox.com” Prizes (33 total; one [1] for each Day of the Sweepstakes Voting Period): Each winner will receive an Xbox 360 Arcade console. ARV: $200.00 each. Winner must accept prize as stated, or prize will be forfeited and awarded to an alternate winner. Any difference between stated value and actual value will not be awarded. Total ARV of all prizes is $8,580.00.
6. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsors or Promotion Parties resulting from entrant's participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by the Sponsors or Promotion Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; errors or limitations of any Internet or phone service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the phone network, Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Sweepstakes. Sponsors are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. Sponsors and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Sweepstakes.
By participating in the Sweepstakes, entrants (or entrant's parent or legal guardian if entrant is an eligible minor) release Sponsors and Promotion Parties from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Sweepstakes. By accepting a prize, recipient (or parent or legal guardian) (a) agrees that the Sponsors and Promotion Parties, participating retailers, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of prize and (b) grants (and agrees to confirm grant in writing promptly upon request) to Sponsors and those acting under Sponsors' authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information, at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet without review, notification or approval, and additional compensation, unless prohibited by law. Sponsors are not liable in the event that any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”).
7. GENERAL CONDITIONS: Winners are solely responsible for any taxes on the prize, and will receive an IRS Form 1099 for the ARV of the prize, if applicable. No cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsors. No transfer of prize is permitted. Unclaimed prizes will not be awarded. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsors reserve the right to substitute prize with another prize of equal or greater value. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsors reserve the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Sweepstakes. In the event of cancellation, Sponsors will randomly award the prizes among all eligible, non-suspect entries received prior to cancellation. This Sweepstakes is offered only in the United States and is governed by the laws of the state of Texas, and all claims must be resolved in the federal or state courts located in Collin or Dallas counties, Texas.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
8. WINNER NOTIFICATION: Winners will be notified by phone, mail and/or email. If attempted notification is returned as undeliverable, if winner cannot be contacted or verified, if winner is otherwise unable to accept the prize as stated, or if winner otherwise disqualifies, prize will be forfeited and may be awarded to an alternate winner. Prizes won by an eligible entrant who is a minor in his or her state of residence may be awarded to a minor’s parent or legal guardian who must sign and return all documents. Winners may be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within seven (7) days of prize notification. In the event of noncompliance within the time period stated herein, prize may be forfeited and an alternate winner may be selected at Sponsors' discretion.
